5. Donations and Financial Transactions

Our donation process involves an inquiry form, not direct payment processing on our Site. When you submit a donation inquiry:

• You represent that your donation does not originate from proceeds of crime, corruption, or activities harmful to the environment.
• You acknowledge that we will review your inquiry and may request additional information before providing bank details.
• You understand that all donations are voluntary and non-refundable once transferred.
• You agree that we may decline any donation at our sole discretion.

We are not responsible for any third-party payment processing fees or errors that may occur during bank transfers.

6. Volunteer and Programme Applications

When you submit an application to volunteer or register interest in our programmes (including SolarUp360):

• You represent that all information you provide is accurate and complete.
• You understand that submission of an application does not guarantee acceptance.
• You consent to being contacted via the information you provide.
• You agree to notify us promptly of any changes to your contact information.
• You acknowledge that volunteer positions are unpaid unless otherwise specified.

7. Third-Party Links and Services

Our Site may contain links to third-party websites or services (including Google Forms). We do not control, endorse, or assume responsibility for any third-party content, privacy policies, or practices. You acknowledge and agree that:

9. Limitation of Liability

This limitation applies regardless of the legal theory under which damages are sought, whether contract, tort (including negligence), strict liability, or otherwise.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

10. Indemnification

12. Termination

We reserve the right, in our sole discretion, to terminate or suspend your access to all or part of the Site, without notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Site will immediately cease.

Sections that by their nature should survive termination (including Intellectual Property, Disclaimer, Limitation of Liability, Indemnification, and Governing Law) shall survive.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms or your use of the Site shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration in Ado-Ekiti, Ekiti State, Nigeria, in accordance with the Arbitration and Conciliation Act, Cap. A18, Laws of the Federation of Nigeria, 2004.

Each party shall bear its own costs of arbitration, and the arbitrator's award shall be final and binding.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ecoweb360 Environmental Foundation regarding your use of the Site and supersede all prior agreements and understandings.
